Payment terms and Conditions

This document (the “PTC”) sets forth the terms and conditions under which the services provided through the  domain name (the “Site”) and offered by SMARTMONKEY SCALABLE COMPUTING SL (the “Services”) are to be paid and invoiced. SMARTMONKEY SCALABLE COMPUTING SL (“us”, “we” or the “Company”) is a Spanish entity with registered address at Carrer Sant Antoni Maria Claret, 330, Barcelona 08041 (Spain), and C.I.F. 1. General

We reserve at any time the right to require payment of fees for certain or all Services. You shall pay all applicable fees, as described on the Site, in connection with those of our Services selected by you. We reserve the right to change the price and to institute new charges at any time upon notice to you (i.e. on the website and/or by email).

By continuing to use or access the Services after such changes come into effect, you agree to be bound by the new or increased charges.

Any fees paid hereunder are non-refundable.

2. Price

The prices for the Services include VAT and any other taxes, as applicable. VAT is the value added tax that must be applied to the Services sold within the European Union (EU). If you are located within Spanish territory, VAT must be paid in all cases. If you are located within the EU and you have received a VAT number issued by a member State of the European Union, you may use your VAT number when making payment and, thus, you may be exempted from paying VAT.

3. Payment

Payment of the Services is to be made by credit or debit card. Payments are processed by means of a third party, which is certified in accordance with PCI Level 1 requirements. Therefore, we have no access to payment information, nor subsequently store said piece of information.

You must update the payment information provided to us from time to time, in order to ensure that its accurate and up-to-date. Should a payment not be processed because you fail to meet the obligations set forth in this section, your access to or use of the Services may be suspended or terminated.

4. Invoicing and reimbursements

The Services are invoiced in advance, with monthly or annual frequency, depending on the period contracted. You expressly authorize us to issue electronic invoices for the Services, that will be sent to the email address you provided when creating your Account.

Fees are nonrefundable. We will not refund any amount nor grant any credit for contracts that are cancelled before reaching their end date.

5. Use of data

The client accept the usage of the data collected in order to improve the tool. The company will not use or access any data that is not directly shared with them or access any other data that was not allowed to do it. The customer will not do an unexpected use of the tool or services. In a enunciative but not limitative way, the client will not perform unexpected number of calls, optimizations or any other request. The tools is strictly forbiden to use to non-legal activities in the country of clients residence.

5.1. Use of Google user data

The client accept to be collected their e-mail address and the data stored in the specified Google Sheets file for optimization purposes only. The add-ons will not access, read or modify any other file of the user that is not intended to be used for route optimizations or geocoding purposes.
